BAIAC enters into MoU with BICAM (Borneo International Centre for Arbitration and Mediation) On July 19, 2023, BAIAC and BICAM signed a collaboration memorandum of understanding in Kota Kinabalu to advance the growth of arbitration and ADR throughout Southeast Asia and beyond. Thereafter on 20 July 2023, BAIAC’s President spoke at BICAM’s pre-launch seminar which was well attended by practitioners and jurists from Malaysia, Singapore, Brunei and China. The BICAM inauguration was a noteworthy occasion that featured plenty of noteworthy camaraderie, amicable banter, and thoughtful discussion among prominent regional arbitration practitioners. BAIAC-Advocates Association of Sarawak (Kuching Branch) inaugural course on introduction to international commercial arbitration 23 June 2023 BAIAC and Advocates Association of Sarawak (Kuching Branch) successfully conducted an in-person course on introduction to international commercial arbitration in Kuching, Sarawak, East Malaysia. The course, which was the first for the members of the Advocates Association of Sarawak (AAS), was well-attended. Another indication of the increased demand for ADR and arbitration for cross-border dispute resolution is Sarawak’s enormous regional economic and investment boom. BAIAC would like to thank the Chairman of the AAS Kuching Branch Mr Liew Tang Chieh, Committee Members, especially Mr Nicholas Wung and Mr Alex Ngu who painstakingly made the course a success.

BAIAC introducing dual panel arbitrators 12 May 2023 A two-panel arbitrator system with a Senior Panel and Ordinary Panel will now be implemented by BAIAC. Given the existing demand on arbitrators and the growing complexity of arbitrations, the justification for this new method is fairly clear-cut and logical.  The Senior Panel arbitrators are intended for exacting disputes of which they have both the experience and expertise. This way, arbitration can be handled efficiently and effectively for the benefits of the parties. The Ordinary Panel arbitrators continue to be the foundation of BAIAC given their experience, expertise and availability to dedicate their time to conducting arbitration efficiently and competently. Appointment of new Senior Advisor and Committee Members 1 May 2023 BAIAC is very pleased to announce the appointment of new Senior Advisor and Committee Members, commencing on 1 May 2023 for a term of 3 years. (1) Senior Advisor – Tan Sri Datuk Seri Panglima David Wong Dak Wah was the fifth Chief Judge of Sabah & Sarawak from July 2018 until his retirement in February 2020. In 2013, he elevated as a Judge of the Court of Appeal of Malaysia during which time, Tan Sri oversaw the Construction Appeal Panel which dealt mainly with claims from construction disputes, matters arising from awards emanating from ad hoc arbitration and arbitrations conducted under the auspices of Asian International Arbitration Centre and matters concerning decisions pursuant to Construction Industry Payment and Adjudication Act 2012. (2) Committee Member – Asst.Prof.Dr. Tidarat Sinlapapiromsuk  is a full-time professor of law at Chulalongkorn University Faculty of Law, Bangkok, where she formerly served as the Vice Dean for International Affairs (2017-2021). Dr Tidarat was also officially appointed by the Office of the Council of State as a legislation review committee for the draft national legislation implementing the UN Convention on Contracts for the International Sale of Goods. (3) Committee Member – Dr RMP M. Idwan Ganie is a Founding Partner of the Indonesian Law Firm Lubis Ganie Surowidjojo (LGS), Jakarta and has been practising law for more than 40 years. Dr Ganie is a highly sought-after and respected lawyer as well as an arbitration expert in Indonesia.

MoU between BAIAC and E-Sarvatra (ADRes)

BAIAC and ADR e-Sarvatra Private Limited (“ADReS”) entered into a cooperation Memorandum of Understanding (MoU) on 22 May 2022. The signing took place in Kochi on 22 May 2022 between Professor Steve Ngo, President of BAIAC and Dr Harish Narasappa, Senior Advocate, Co-Founder and Director of ADReS. Based in Bangalore which is commonly identified India’s ‘Silicon Valley’, ADReS has built a proprietary online platform (ADReS Now) which facilitates dispute resolution through bespoke technology that is accessible, innovative, intuitive, and secure. It uses technology to seamlessly integrate case management, workflow management, and video conferencing systems, thus offering users an unparalleled experience for virtual arbitration hearings. Under the terms of the MoU, among others, both parties would be cooperating on making available ADReS Now in Southeast Asia and East Asia, as virtual and electronic hearing platforms are increasingly in demand especially since the pandemic. BAIAC will also be making available its panel of arbitrators to ADReS Now for appointment under its online protocol, joint courses and the promotion of BAIAC rules. MoU between BAIAC and the Federation of Indian Corporate Lawyers (FICL)

27 May 2022, New Delhi. BAIAC is pleased to enter into a cooperation MoU with the Federation of Indian Corporate Lawyers (FICL). The signing took place at Taj Palace Hotel, New Delhi during FICL’s inaugural corporate lawyers summit, between the CEO of FICL Dr Ashok Sharma and BAIAC’s President. FICL is a not-for-profit organisation that is committed to provide a national platform for the exchange of information, experience and knowledge within the Indian corporate legal community and to enhance recognition of corporate lawyers amongst the business and legal community in India. FICL is promoting and collaboration within the Indian corporate legal community for developing best practices for professional growth. The parties would be exploring joint events and seminars in connection with international commercial arbitration and mediation. In addition, FICL will be promoting the use of BAIAC arbitration rules.
