MoU between BAIAC and E-Sarvatra (ADRes)

BAIAC and ADR e-Sarvatra Private Limited (“ADReS”) entered into a cooperation Memorandum of Understanding (MoU) on 22 May 2022. The signing took place in Kochi on 22 May 2022 between Professor Steve Ngo, President of BAIAC and Dr Harish Narasappa, Senior Advocate, Co-Founder and Director of ADReS. Based in Bangalore which is commonly identified India’s ‘Silicon Valley’, ADReS has built a proprietary online platform (ADReS Now) which facilitates dispute resolution through bespoke technology that is accessible, innovative, intuitive, and secure. It uses technology to seamlessly integrate case management, workflow management, and video conferencing systems, thus offering users an unparalleled experience for virtual arbitration hearings. Under the terms of the MoU, among others, both parties would be cooperating on making available ADReS Now in Southeast Asia and East Asia, as virtual and electronic hearing platforms are increasingly in demand especially since the pandemic. BAIAC will also be making available its panel of arbitrators to ADReS Now for appointment under its online protocol, joint courses and the promotion of BAIAC rules. BAIAC’s President, Professor Steve Ngo said “The MoU is an important event for us and also the arbitral community at large. MoU between BAIAC and the Federation of Indian Corporate Lawyers (FICL)

27 May 2022, New Delhi. BAIAC is pleased to enter into a cooperation MoU with the Federation of Indian Corporate Lawyers (FICL). The signing took place at Taj Palace Hotel, New Delhi during FICL’s inaugural corporate lawyers summit, between the CEO of FICL Dr Ashok Sharma and BAIAC’s President. FICL is a not-for-profit organisation that is committed to provide a national platform for the exchange of information, experience and knowledge within the Indian corporate legal community and to enhance recognition of corporate lawyers amongst the business and legal community in India. FICL is promoting and collaboration within the Indian corporate legal community for developing best practices for professional growth. The parties would be exploring joint events and seminars in connection with international commercial arbitration and mediation. In addition, FICL will be promoting the use of BAIAC arbitration rules.

17 Jan 2022 – BAIAC entered into a cooperation MoU with the Malaysia-Laos Business Council Organization (MLBCO).

January 24, 2022

On 17 January 2022, BAIAC and MBLCO entered into a cooperation MoU. A  ceremony was held an event in Kuala Lumpur by MBLCO for the signing of various MoUs with parties from the region. Lao’s Deputy Minister of Technology and Communication, Dr Santisouk Simmalavong and Malaysia’s Minister in the PM’s Department (Economy) Dato’ Sri Mustapa Mohamad delivered official speeches virtually from Lao and in-person in Kuala Lumpur. The MLBCO is established to promote Malaysia-Lao business links through private and public sectors. The MoU signing entails the use of BAIAC arbitration clause and rules in contracts involving the MLBCO. In addition, BAIAC will also be assisting MLBCO with trainings in relation to the conduct of arbitration for cross-border trade disputes.

MoU signing betwen BAIAC and Thammasat University, Faculty of Law

SIGNING OF COOPERATION MOU BETWEEN THAMMASAT UNIVERSITY, FACULTY OF LAW AND BEIHAI ASIA INTERNATIONAL ARBITRATION CENTRE, SINGAPORE 1 May 2021. BAIAC and the Faculty of Law, Thammasat University (TU Law), Bangkok, have entered into a cooperation Memorandum of Understanding (MoU). Faculty of Law, Thammasat University is the oldest law school in Thailand and is highly regarded for producing the country’s eminent leaders and figures since its inception in 1934. Beihai Asia International Arbitration Centre (BAIAC) is a Singapore based arbitration centre established by the Beihai Arbitration Commission, focussing on international commercial disputes arising from ASEAN, China and the BRI countries. With the signing of the MoU, the parties hope to develop mutually beneficial cooperation in the area of arbitration training, education and research involving the ASEAN region with a focus on Thailand, Singapore and Guangxi. In addition, the parties would also be working on a pilot programme to train faculty members of TU Law as international arbitrators and experts.

Article: The Tribunal’s Power of Attorney to register an arbitral award in Indonesia

Indonesian law requires that arbitral awards must first be registered with the Indonesian courts before enforcement proceedings can commence. Crucially however, responsibility for registration lies with the arbitral tribunal, not the parties. If the tribunal does not undertake certain steps before it becomes functus officio, a party can find itself with a valid award that cannot be enforced in Indonesia.
